Pharmacy Regulation - Consultation on Draft Legislation

In September 2009, the Department of Health and Human Services (DHHS) published a consultation paper titled, Pharmacy regulation: ongoing regulation of pharmacy ownership and registration of pharmacy business premises in Tasmania. The paper sought feedback in relation to how regulation functions regarding pharmacies would continue in Tasmania following the commencement of the National Registration and Accreditation Scheme for health professions (the national scheme).

Following receipt of feedback from a number of interested stakeholders, DHHS has prepared legislation to amend the Pharmacists Registration Act 2001. It is intended that a Bill to amend the existing Act will be tabled for debate following the resumption of Parliament after the State election.

A draft version of the proposed Pharmacy Control Act 2001 is now available for consultation, along with proposed transitional clauses and fees regulations.

The draft legislation is intended to represent, subject to Parliament approving the amending Bill, the law with respect to pharmacy regulation following the introduction of the national scheme in Tasmania. Please note that the legislation is subject to further revision following the consultation period. The legislation may also be amended at the discretion of any incoming government following the State election.
