PUBLIC HEALTH (TOBACCO SELLER'S LICENCE) AMENDMENT REGULATIONS 2016

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Public Health Act 1997.

1. Short title

These regulations may be cited as the Public Health (Tobacco Seller’s Licence) Amendment Regulations 2016.

2. Commencement

These regulations take effect on 1 January 2017.

3. Principal Regulations

In these regulations, the Public Health (Tobacco Seller’s Licence) Regulations 2009* are referred to as the Principal Regulations.

4. Regulation 4 substituted

Regulation 4 of the Principal Regulations is rescinded and the following regulation is substituted:

  • 4. Fees
  1. For section 74B of the Act, the prescribed fee for an application for a tobacco seller’s licence is –
    1. in the case of an application made in the period from 1 January 2017 to 31 December 2017 (both days inclusive), 478 fee units for each premises specified in the application; and
    2. in the case of an application made on and from 1 January 2018, 717 fee units for each premises specified in the application.
  2. For section 74F of the Act, the prescribed fee for an application for the renewal of a tobacco seller’s licence is –
    1. in the case of an application made in the period from 1 January 2017 to 31 December 2017 (both days inclusive), 478 fee units for each premises specified in the application; and
    2. in the case of an application made on and from 1 January 2018, 717 fee units for each premises specified in the application.

These regulations amend the Public Health (Tobacco Seller’s Licence) Regulations 2009 by increasing the fees payable for the application, or renewal, of a tobacco sellers’ licence
